Welcome to Mosaic VPN. The Services are provided by QUIC PTE. LTD., These Terms of Service ("Terms") govern your use of our website, applications, and VPN services (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

These Terms constitute a legally binding agreement between you and Mosaic VPN regarding your use of the Service.

Service Description

Mosaic VPN provides a virtual private network service that allows users to access the internet with enhanced privacy and security. The Service is available across multiple platforms, including iOS, Android, Windows, MacOS, and Chrome browser.

We strive to maintain high-quality service, but we cannot guarantee uninterrupted, timely, or error-free service. We reserve the right to modify, suspend, or discontinue any aspect of our Service at any time.

User Accounts

To use certain features of our Service, you may need to create an account. You are responsible for:

  • Providing accurate and complete account information
  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use or security breach

We reserve the right to terminate or suspend accounts that violate these Terms or for any other reason at our discretion.

Acceptable Use

You agree to use our Service only for lawful purposes and in accordance with these Terms. You are solely responsible for all activities conducted through the Service.

Prohibited Activities

You agree not to use the Service to:

  • Violate any applicable laws, regulations, or third-party rights
  • Engage in illegal activities including but not limited to fraud, terrorism, or child exploitation
  • Distribute malware, viruses, or other harmful code
  • Attempt to gain unauthorized access to any network, system, or account
  • Interfere with or disrupt the Service or servers connected to the Service
  • Engage in excessive use that may negatively impact other users
  • Resell or share your account access with others

We reserve the right to investigate and take appropriate legal action against violations of these Terms, which may include terminating your account without refund.

Subscription and Billing

Some features of our Service require a paid subscription. By subscribing to our Service, you agree to:

  • Pay all fees associated with your subscription plan
  • Provide accurate and complete payment information
  • Be charged automatically at the beginning of each billing cycle unless you cancel

Subscription fees are non-refundable except where required by law. We reserve the right to change our prices with reasonable notice. Continued use of the Service after a price change constitutes acceptance of the new price.

Cancellation and Termination

You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing cycle.

We may terminate or suspend your account for violations of these Terms or for any other reason at our discretion, with or without notice. Upon termination, your right to use the Service will cease immediately.

Refund Policy

(1) If you purchased the Mosaic VPN product (or Service) from the Mosaic VPN official Website, we offer you a 30-day money-back guarantee. You may cancel your subscription for any reason within 30 days of your initial purchase and you will receive a full refund of the amount you paid. Please note that we do not grant money-back guarantee for the auto-renewed subscription if you cancel the subscription after the day of charge for such auto-renewal, unless applicable law provides otherwise.
Refunds beyond the 30-day purchase window will be considered, at the sole discretion of Mosaic, if you can demonstrate that the Service was not available or usable during the subscription period and that reasonable attempts were made to contact Mosaic to resolve the issue. In this case, Mosaic may provide the Subscriber with a pro-rata refund of service fees paid during the period when the Service was not available or usable.

(2) If you purchased our Apps from the Apple App Store, the 30-day money-back guarantee is not available. Instead, such subscriptions are subject to Apple's App Store Refund Policy, and you may request a refund through the App Store, at Apple's sole discretion.

(3) If you purchased the Mosaic VPN product (or Service) from Google Play Store, you do not have access to the 30-day money-back guarantee. Only if you can demonstrate that the Service was not available or usable during the subscription period and that reasonable attempts were made to contact Mosaic to resolve the issue, Mosaic may provide you with a pro-rata refund of service fees paid during the period when the Service was not available or usable.

(4) Your request will be processed without any unreasonable delay and the refund will be paid using the same payment method as the one used for the purchase, except as otherwise mutually agreed, unless applicable law prohibits us or payment service providers we rely on from processing the refund. For payments made in cryptocurrency, the refund will be made in USD. The amount to be refunded in cryptocurrency will be calculated based on the equivalent of the price paid in USD at the time of purchase. Payments made using prepaid cards or gift cards will not be refunded if such refund is not supported by the provider of the card. Once the refund is issued to you, you will lose access to the Services for which you were refunded.

(5) If you want a refund or unsubscribe, please do not delete your account before completing the operation. Deleting your account will simultaneously delete all your information in our system, causing the system to be unable to find your order, making it impossible to refund or unsubscribe.

Intellectual Property

All content, features, and functionality of our Service, including but not limited to text, graphics, logos, icons, images, code, and software, are the exclusive property of Mosaic VPN or our licensors and are protected by copyright, trademark, and other intellectual property laws.

You agree not to reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, or transmit any portion of the Service without the prior written consent of Mosaic VPN.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE OR SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MOSAIC VPN AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE
  • ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE
  • ANY CONTENT OBTAINED FROM THE SERVICE
  • UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT

Indemnification

You agree to defend, indemnify, and hold harmless Mosaic VPN and its officers, directors, employees, agents, partners, and licensors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms shall be exclusively brought in the courts of [Your Jurisdiction].
